How this was written: these terms cover a free tool with no payments, no accounts, and no warranty — kept deliberately short because there isn't much to govern. They were not drafted or reviewed by a lawyer. If Upgrade ever starts charging money, collecting accounts, or processing payments, get a real legal review before that launches — not before this free v1.

1. Acceptance

By downloading, installing, or using Upgrade, or by using this website, you agree to these terms. If you don't agree, don't use the software or the site.

2. The software is free to use, not open source

Upgrade is distributed at no cost under the terms in the License. You're free to install and use it, including for commercial work — but the language's own source code isn't published, and the license doesn't grant rights to copy, redistribute, or reverse-engineer the software itself. Programs you write using Upgrade are entirely yours, under whatever terms you choose; that's unaffected by any of this.

3. No warranty

Upgrade is provided "as is," without warranty of any kind, express or implied — including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement. You use it at your own risk.

4. Limitation of liability

To the fullest extent permitted by law, the author of Upgrade is not liable for any claim, damages, or other liability arising from, out of, or in connection with the software or its use — including data loss, downtime, or any indirect, incidental, or consequential damages.

5. Acceptable use

Don't use Upgrade to build or distribute malware, to violate any law, or to abuse any third-party service it talks to (including the optional AI error helper's third-party AI provider, when you choose to enable it).

6. Third-party services

Programs you write in Upgrade can call out to services you specify (via do web.* actions) and, optionally, to a third-party AI provider (via the AI error helper). Your use of those services is governed by their own terms, not these.

7. Changes

The software, this site, and these terms may change over time. Continued use after a change means you accept the updated terms.

8. Governing law

Upgrade is free software with no payments and no accounts, distributed worldwide. Rather than naming one jurisdiction, these terms are intended to apply consistently wherever you are, alongside any consumer-protection law in your location that can't be excluded by agreement.
